**Art. 2 – Object**
1. These General Terms and Conditions of Sale regulate the offer, forwarding, and acceptance of purchase orders for products on Sergio Savino by CVS Italia Srl and do not regulate the supply of services or the sale of products by parties other than the seller who may be present on the same site via links, banners, or other hypertext links.
2. Before forwarding orders and purchasing products and services from parties other than the seller, we suggest checking their terms of sale.
**Art. 3 – Conclusion of the Contract**
1. To conclude the purchase contract, it is necessary to complete the form in electronic format and transmit it following the related instructions.
2. The form contains a reference to the General Terms and Conditions of Sale, images of each product and their price, the payment methods that can be used, the delivery methods for the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and methods and times for returning the purchased products.
3. Before concluding the contract, it will be required to confirm the acknowledgment of the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.
4. The contract is concluded when the seller receives the form completed by the user, after verifying the correctness of the data contained therein.
5. The user will be obliged to pay the price from the moment the online order forwarding procedure is completed. This will occur by clicking the “________” button at the end of the guided procedure.
6. Once the contract is concluded, the seller will take charge of the order for its execution.
**Art. 4 – Registered Users**
1. By completing the registration procedures, the user agrees to follow the instructions on the site and to provide their personal data correctly and truthfully.
2. Once registered, the user will receive a confirmation email at the email address provided. The confirmation must be communicated within a maximum of 48 hours. After this period, in the absence of confirmation, Sergio Savino by CVS Italia Srl will be released from any commitment to the user.
3. In any case, the confirmation will exempt Sergio Savino by CVS Italia Srl from any responsibility for the data provided by the user. The user undertakes to promptly inform Sergio Savino by CVS Italia Srl of any changes to their data at any time.
4. If the user provides inaccurate or incomplete data, or if there is a dispute by the concerned parties regarding the payments made, Sergio Savino by CVS Italia Srl will have the right not to activate or to suspend the service until the relevant deficiencies are remedied.
5. On the first request for profile activation by the user, Sergio Savino by CVS Italia Srl will assign a username and a password. The user recognizes that these identifiers constitute the system for validating the user’s access to the Services and the only system suitable for identifying the user and that the actions carried out through such access will be attributed to and have binding effect on the user.
6. The user undertakes to maintain the secrecy of their access data and to guard them with due care and diligence and not to transfer them, even temporarily, to third parties.
**Art. 5 – Product Availability**
1. Product availability refers to the actual availability at the time the user places the order. This availability must however be considered purely indicative as, due to the simultaneous presence of multiple users on the site, products could be sold to other customers before the order is confirmed.
2. Even after sending the order confirmation email, partial or total unavailability of the goods may occur. In this case, the order will be automatically rectified with the elimination of the unavailable product and the user will be immediately informed via email.
3. If the user requests the cancellation of the order, resolving the contract, Sergio Savino by CVS Italia Srl will refund the amount paid within 30 days from the moment Sergio Savino by CVS Italia Srl became aware of the buyer’s decision to terminate the contract.

**Art. 7 – Payment Methods and Prices**
1. The price of the products will be the one indicated from time to time on the site, except where there is an obvious error.
2. In case of an error, Sergio Savino by CVS Italia Srl will inform the buyer as soon as possible, allowing the confirmation of the order at the correct amount or cancellation. In any case, Sergio Savino by CVS Italia Srl will not be obliged to supply what was sold at the lower incorrectly indicated price.
3. Site prices include VAT but do not include shipping costs. Prices may change at any time. The changes do not affect orders for which an order confirmation has already been sent.
4. Once the desired products are selected, they will be added to the cart. It will be sufficient to follow the purchase instructions, entering or verifying the required information in each step of the process. Order details can be modified before payment.

**Art. 8 – Delivery**
1. Sergio Savino by CVS Italia Srl ships throughout Italy, excluding the Vatican City State and the Republic of San Marino.
2. Sergio Savino by CVS Italia Srl will only deliver to the user’s home, provided at the time of purchase.
3. Delivery is generally made within a time to be agreed upon for Italy, or if no delivery date is specified, within the estimated time at the time of selecting the delivery method, and in any case within a maximum of thirty days from the date of confirmation.
4. For EU countries, delivery will be made within a time to be agreed upon, and in any case within a maximum of thirty days.
5. For non-EU territories, delivery will occur approximately within a time to be agreed upon.
6. If delivery is not possible, the order will be sent to the warehouse. In this case, a notice will specify the location of the order and how to arrange a new delivery.
7. If the user is unable to be present at the delivery location at the agreed time, they are asked to contact us again to arrange a new delivery date.
8. If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we will assume that the contract is intended to be resolved.

As a result of the resolution, the amounts will be refunded, including delivery costs with the exclusion of any additional costs resulting from the choice of a delivery method other than the ordinary method offered without undue delay and, in any case, within 30 days from the date of contract resolution. The transportation resulting from the resolution of the contract may have additional costs that will be borne by the buyer.

**Art. 9 – Transfer of Risk**
1. The risks related to the products will be borne by the buyer from the moment of delivery. Ownership of the products is considered acquired upon receipt of full payment of all amounts due in relation to them, including shipping costs, or at the time of delivery if this occurs at a later time.
**Art. 10 – Warranty and Commercial Conformity**
1. The seller is liable for any defect in the products offered on the site, including the non-conformity of the items to the products ordered, in accordance with Italian legislation.
2. If the buyer has entered into the contract as a consumer, i.e., any natural person acting on the site for purposes unrelated to any business or professional activity carried out, this warranty is valid provided that the defect occurs within 24 months from the date of delivery of the products; that the buyer formally complains about the defects within a maximum of 2 months from the date on which the defect was recognized; that the online return form is correctly filled out.
